These Terms of Service (“Terms”) govern your use of the website and games at https://www.cbthero.com (the “Service”), operated by CBTHero.com (“we,” “us,” or “our”). By accessing or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
The Service is a set of interactive, illustrated games that let children and teens practice skills drawn from cognitive behavioral therapy, such as noticing unhelpful thinking patterns, considering alternative explanations, naming emotions, and taking gradual steps toward things that feel scary. It is intended as an educational and skills-practice tool, for use on its own or alongside work with a qualified professional.
The Service is not, and does not provide:
Nothing in the Service — including scenarios, “answer keys,” explanations, scores, badges, discussion prompts, or homework reports — is a clinical recommendation or a statement about any individual’s mental health. Content is general and illustrative, and it may not be appropriate for every person or situation.
The Service includes a “Guide” role designed for therapists, counselors, and other adults to use with a child or teen. Any licensed professional who uses the Service does so as part of their own independent professional practice and remains solely responsible for all clinical judgment, for deciding whether and how the Service is appropriate for a particular client, for obtaining any consents their profession or jurisdiction requires, and for complying with all laws, regulations, licensing rules, and ethical standards that apply to them, including any privacy or recordkeeping obligations. We do not supervise, review, or take part in any professional’s use of the Service.
The games are designed for young people roughly ages 11 to 14 and are intended to be used with the knowledge and consent of a parent or legal guardian, or under the guidance of a qualified professional working with that family. If you are under 18, you may use the Service only with the permission of a parent or guardian. If you are a parent, guardian, or professional who allows a minor to use the Service, you agree to these Terms on that minor’s behalf and you are responsible for supervising their use.
We do not require accounts and do not knowingly collect personal information from anyone. See our Privacy Policy for what is and is not processed.
The Service is not monitored by any person in real time. Nothing you or a child types into the Service is read by us, and no one will respond to it. If you believe someone is at risk of harming themselves or others, or is experiencing a medical or mental-health emergency, stop using the Service and contact emergency services immediately — in the U.S., call or text 988, text HOME to 741741, or call 911.
You agree not to: use the Service for any unlawful purpose or in violation of these Terms; attempt to access another person’s game room without their invitation; interfere with, disrupt, probe, or reverse-engineer the Service or its infrastructure; scrape, harvest, or reproduce the Service’s content for redistribution or to train models without our written permission; or use the Service to harass, harm, or exploit any person, especially a minor. Rooms and room codes are shared at your own discretion; you are responsible for who you invite.
The Service, including its games, scenarios, text, artwork, characters, code, and branding, is owned by CBTHero.com or its licensors and is protected by copyright, trademark, and other laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose. Professionals may use the Service with their own clients as part of their practice. All other rights are reserved.
The Service is delivered using third-party infrastructure, including web hosting, a real-time connection service that relays game state between the two players in a room, and a privacy-focused analytics service. Those providers process limited technical information under their own terms and policies, as described in our Privacy Policy. We are not responsible for third-party services or for any website we link to.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. We make no representation or warranty that the Service will produce any particular educational, emotional, behavioral, or clinical outcome, that its content is complete or suitable for any individual, or that it meets the requirements of any law, regulation, or professional standard applicable to you. Some jurisdictions do not allow the exclusion of implied warranties, so some of these exclusions may not apply to you.
TO THE FULLEST EXTENT PERMITTED BY LAW, CBTHERO.COM AND ITS OWNERS, OPERATORS, EMPLOYEES, CONTRACTORS, CONTENT CONTRIBUTORS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, USE, OR GOODWILL, OR FOR ANY PERSONAL INJURY, EMOTIONAL DISTRESS, OR OTHER HARM, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, ANY DECISION MADE OR ACTION TAKEN IN RELIANCE ON THE SERVICE, OR ANY USE OF THE SERVICE BY A MINOR IN YOUR CARE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT WILL OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE EXCEED THE GREATER OF THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM OR ONE HUNDRED U.S. DOLLARS (US$100). Some jurisdictions do not allow certain limitations of liability, so some of these limitations may not apply to you.
You understand that engaging with content about emotions, fears, frustration, and difficult social situations can be uncomfortable, and that the Service may not be appropriate for every child or every moment. You voluntarily choose to use the Service, or to allow a minor in your care to use it, and you assume all risk of doing so. To the fullest extent permitted by law, you release CBTHero.com and the parties listed in Section 10 from any and all claims arising out of such use.
You agree to defend, indemnify, and hold harmless CBTHero.com and the parties listed in Section 10 from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or related to your use of the Service, your violation of these Terms, your violation of any law or the rights of any third party, or — if you are a professional — your professional use of the Service with clients.
We may change, suspend, or discontinue any part of the Service at any time without notice. We may update these Terms from time to time; the “Last updated” date above shows when they last changed. Your continued use of the Service after a change means you accept the updated Terms.
These Terms are governed by the laws of the United States and of the state in which the operator of the Service is located, without regard to conflict-of-laws rules. If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.
